Complex legal fights over drug use by workers in the 31 states with medical marijuana, including New York, and 10 with recreational pot have already been playing out across the country.

KEY POINTS

-Enforcement is difficult because marijuana appears on drug tests long after impairing effects subside.

-Marijuana tops the list of most commonly detected illicit substances across all workforce drug tests.

-The rate of marijuana positives in urine based drug tests in the American workforce hit 2.8% in 2018.

-Quest found that 5.3 percent of retail workers tested positive for any type of illicit drugs in 2017.
